Our Order Request Terms

General Terms

By submitting an order request through VinoApp Checkout (“VinoApp Checkout”), via the VinoApp (“the App”) or the VinoApp Website (“the Site”), you agree to be bound by the following VinoApp (“VinoApp”, “we”, “us” or the “Company”) Checkout Order Request Terms. By using the VinoApp App or Site, you also agree to be bound by all policies set out on the VinoApp Website, www.vinoapp.co, including the following:

VinoApp may, in its sole discretion, revise the VinoApp Checkout Order Request Terms from time to time, and it is your responsibility to review the VinoApp Checkout Order Request Terms each time you submit an order request through Vinopp Checkout. VinoApp may, in its sole discretion, revise the additional policies listed above, and it is your responsibility to review those policies each time you use VinoApp Checkout. Your continued use of the VinoApp App or Site, or your submission of an order request through VinoApp Checkout, constitutes your agreement to any such modifications.

1. How VinoApp App Order Requests Work
Order requests submitted through VinoApp Checkout are not fulfilled by VinoApp. VinoApp does not sell alcoholic beverages. VinoApp has partnered with Almavin LLC and other several third-party licensed sellers (“Sellers”) who sell alcohol through VinoApp Checkout. Prior to the final submission of your order request, VinoApp Checkout identifies the specific Seller to which your order request will be submitted. The Seller identified by VinoApp Checkout will be the sole party responsible for the sale of alcoholic beverages to you. Each Seller is responsible for compliance with all applicable laws and regulations.
These Vinopp Checkout Order Request Terms govern your relationship with VinoApp, but you must consult the Seller’s website for additional terms, conditions, or policies that may apply to your relationship with and your purchase from the Seller. Submitting an order request through VinoAppCheckout constitutes your agreement to any and all applicable seller policies including but not limited to purchases made for resale which are not allowed on the VinoApp platform.
After you submit your order request through VinoApp Checkout, VinoApp will send your order request to the Seller. The Seller will review your order request, and may accept or reject your order. If accepted, your payment will be processed and the Seller will ship your order per these VinoApp Checkout Order Request Terms and per any Seller policies. The Seller may reject the order request for any reason, including, but not limited to: inadequate inventory, errors in pricing, compliance with any applicable laws and regulations, or any reason stated in Seller’s policies. Consult the Seller’s policies for further information.

2. Membership and Cancellations
Membership Program. You may become a VinoApp Wine Club Member by providing the requested registration information and submitting it to VinoApp through the VinoApp Sites or Applications. By becoming a Member and placing an order, you agree to receive a shipment of at least 3 bottles of wine from VinoApp once every three months until you cancel your membership. This may subject to change depending on the new features, weather conditions and wines we decide to include. You may suspend or cancel your membership any time. However, if you fail to cancel your membership one week prior to your next shipment, you will be charged for that shipment. Taxes may apply based on the shipping address. By becoming a member and providing your membership and credit card information, you authorize VinoApp to charge your credit card (including shipping and any applicable tax) for each quarterly VinoApp Wine Club Membership wine shipment. Please notify us at least 3 days prior to any shipment to update your account information, payment method, change your address and 7 days prior to skip a shipment, or to cancel your membership.

3. Your Order Information
To submit an order request through VinoApp Checkout, you will be required to provide payment, billing, and shipping information. The billing address you provide must match the address on your credit card statement. You may provide a shipping address that differs from your billing address. Please ensure all order information is correct. Once the Seller has accepted your order request, changes to this information may not be possible, and if possible, additional fees or penalties may apply.

4. Representation of Legal Drinking Age
IN THE UNITED STATES, ALCOHOLIC BEVERAGES MAY BE SOLD AND DELIVERED ONLY TO PERSONS WHO ARE AT LEAST 21 YEARS OLD AND BY PLACING YOUR ORDER, YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST 21 YEARS OLD AND THAT THE PERSON TO WHOM DELIVERY WILL BE MADE IS AT LEAST 21 YEARS OLD AND CAN ACCEPT DELIVERY OF ALCOHOLIC BEVERAGES. ALL DELIVERIES OF ALCOHOLIC BEVERAGES WILL REQUIRE THE SIGNATURE OF A PERSON AT LEAST 21 YEARS OLD. THE PERSON RECEIVING DELIVERY MAY BE REQUIRED TO SHOW IDENTIFICATION PROVING THAT HE OR SHE IS AT LEAST 21 YEARS OLD. OUTSIDE OF THE UNITED STATES THE LOCAL MARKET’S LAW REGARDING THE LEGAL DRINKING AGE WILL BE REQUIRED.

5. Shipping & Returns – Shipping Information
Due to the restrictions of many state laws, we only ship wine to those states where direct shipment is permitted by law. At the present time, we can ship to: AK, CA, CO, DC, DE, FL, IA, ID, KS, KY, LA, MO, NE, NH, WV, WY

It is highly recommended that you ship to a business or office, where someone can sign when the carrier attempts delivery.



Shipping Options

Free Home Deliveries
Our marketing team will come up with regular offers to provide free shipping for a certain about of delivery.

Ground with Ice Pack
This is the safest option in the warmer months. Your wines will be shipped ground with ice packs to keep the wine cool. There will be a $5 per case upcharge for the ice packs.

Summer Hold
We will hold your packages in our climate-controlled warehouse in Miami, FL over the summer. Your packages will automatically ship when temperatures have cooled in your region. Typically, weather will permit us to safely ship your wine beginning in September/October.

Local Pickup
If you live in the South Florida Area and you’d like to come by to pick up your wine here in Miami, you may do so at no additional cost. We are available Monday through Friday from 11am to 6pm. To ensure your orders are available before you arrive, please email hello@vinoapp.co to schedule your pickup.

Shipping Delays
Please note that if the weather is too extreme in your area at the time of shipping, we may hold onto your shipment to protect the quality of the wine. We will automatically ship it out to you once weather conditions are appropriate.

State Compliance Laws
Due to ever changing direct-shipping laws and regulations, the list of states that we ship to may change at any time. All wines are sold in Florida and title passes to the buyer in Florida. We will arrange for shipment on behalf of the buyer, to an address specified by the buyer, provided that in our sole discretion we believe that such shipment will not subject us to the risk of any sort of legal action or other harm. If a buyer lives in a state where the direct shipment of wine may violate the law, we will contact the buyer to discuss shipping options, which options may include provision of an alternative shipping address in a state where the direct shipment of wines to consumers is permitted or storage of the wines at an acceptable third-party storage facility.

Returns
We at VinoApp Wine Club stand behind all wines sold. We have a 100% return policy so if you have any issues with the wines please contact us at hello@vinoapp.co and we will either refund or replace your bottles.

6. Fulfillment and Credit Card Transactions:
VinoApp Wine Club is strictly a Marketing Company. All transactions are processed by ALMAVIN LLC, a Florida limited liability company with offices located at 8600 NW South River Dr., Suite 101, Medley, Florida 33166. ALMAVIN is our Wine Retailer Partner and all purchases will be made directly from them since they have the appropriate license to sell wines.

If your order request is accepted by our seller, payment will be processed utilizing the credit card payment information you provide. Your credit card statement will state the name of the seller responsible for the sale and fulfillment of alcoholic beverages to you, as identified by VinoApp Checkout during the order request submission process.
By entering credit card payment information, you represent and warrant that you have the legal right to use any credit card(s) utilized in connection with any transaction initiated through VinoApp Checkout. VinoApp reserves the right to take legal action against persons attempting to fraudulently utilize credit card payment information. Consult the Seller’s policies for further information.
